The petitioners apprehend their arrest in connection with Basantpur (Lakdi Naviganj) P.S. Case No. 164 of 2020 registered under Sections 341, 323, 324, 504, 272, 273, 308, 34 of the I.P.C. and section 30(a) of the Bihar Prohibition and Excise act pending in the Court of 2nd Additional District and Sessions Judge-cum-Special Judge, Excise, Siwan. Submission of learned counsel for the petitioners is that petitioners are innocent and have falsely been implicated in this case due to political differences between the parties. Further submission is that petitioners have no criminal antecedent.
Patna High Court CR. MISC. No.30250 of 2020(5) dt.14-07-2021 2/2 Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioners by contending that petitioners are named in the first information report and there is direct allegation of assault against them. Hence, this is not a fit case for anticipatory bail.
Having considered the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, prayer of the petitioners for bail is rejected.
