JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-07-2019 The present writ petition has been filed for directing the respondents to take suitable action against the respondent no. 6 for his forged and criminal act, which has resulted in loss to the public exchequer inasmuch as he has illegally worked at two places and drawn salary from two places by changing his name from Lohara Bhagat to Lalit Bhagat and vice versa. Perused the supplementary counter affidavit filed on behalf of the respondent no. 2 wherein it has been stated that the Home (Police) Department, Government of Bihar was directed to make inquiry into the matter and an inquiry report has been received vide letter no. 409 dated 22.4.2016 from the Additional Director General of Police (Weaker Section) Crime

Patna High Court CWJC No.260 of 2014(3) dt.19-07-2019 2/2 Investigation Department, Government of Bihar and it has been found that Shri Lohara Bhagat changed his name to Lalit Bhagat and both are in fact one and the same person, who was having two names. Thereafter, a case bearing C.B.I. R.C. Case No. 04(A) / 14 is said to have been registered under Sections 420, 467, 468, 471 of the Indian Penal Code as well as under Section 13(2) read with Section 13(i)(d) of the Corruption Eradication Act, 1988 and the charge-sheet has also been filed in the C.B.I. Court. In the said supplementary counter affidavit, it has further been stated that a decision has also been taken to recover the amount from Sri Lalit Bhagat which has been illegally received by him from the State Scheduled Tribe Commission as Vice Chairman.

Having regard to the fact that the respondents have already taken appropriate action, this Court, being satisfied with the same, does not find any reason to keep the present writ petition pending, hence, the writ petition stands disposed of with a direction to the respondent authorities to ensure that the ongoing proceedings are taken to their logical end.
