The petitioner seeks bail in Luckeesarai (Kawaiya Outpost) Police Station (for brevity PS) Case No 312 of 2017, Protection of Children from Sexual Offences (for brevity, POCSO) Registration No 30 of 2017 instituted for the offence punishable under Sections 366A/120B of Indian Penal Code and Section 8 of POCSO Act.
Prayer for bail of petitioner was earlier rejected by this Court under order dated 16.05.2018 passed in Cr Misc No 18244 of 2018 (Annexure 1).
Report of the trial Court shows that after examination
Patna High Court CR. MISC. No.30460 of 2020(3) dt.24-02-2021 2/2 of all prosecution witnesses, statement of both accused persons have also been recorded. Defence evidence has been closed and case is pending for hearing arguments.
In view of the aforesaid situation, this Court would reject the prayer of petitioner for bail with expectation that the trial will conclude expeditiously without any undue delay and preferably within two months from the date of receipt/production of a copy of this order.
