2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

3. The case of the prosecution, in short, is that one Anup Kumar along with his co-driver was going to deliver iron pipes. All of sudden, four persons intercepted him and on pretext of checking the papers of the truck, snatched the mobile of the driver and co-driver and a cash of Rs. 3,000/- on gun point.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this

Learned counsel for the petitioner has submitted that informant of this case was later on made accused in this case as the iron pipes which were loaded on the truck were stolen. The name of this petitioner has surfaced during course of investigation in the confessional statement of one co-accused Amrendra Kumar. According to the confessional statement of Amrendra Kumar, the petitioner has also helped in the offence. It has further been submitted that nothing has been recovered from the possession of this petitioner. Save and except the confessional statement of co-accused, there is nothing against him. It has further been submitted that the informant of this case who has later on been made accused, has been granted bail by the learned Co-ordinate Bench of this Court vide Cr. Misc.No. 42767 of 2022. The case of this petitioner stands on better footing. Moreover, he is languishing in judicial custody since 02.02.2026.

5. Learned APP appearing for the State has vehemently opposed the application for bail and has submitted that petitioner is having criminal antecedent of one case..

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named

No.30895 of 2026(2) dt.07-05-2026 3/3 petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Arwal in connection with Kaler P.S. Case No. 24 of 2022.
