2. The petitioners have prayed for bail in connection with Dariyapur P.S. Case No. 159 of 2026 registered for the offence punishable under Sections 126(2), 115(2), 109/3(5) of the B.N.S., 2023.

3. The case of the prosecution, in short, is that the petitioners along with others have assaulted the informant and his family members.

4. Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and have committed no offence and have been falsely implicated in the present case. It is further submitted that the nature of the allegations is general and omnibus. Learned counsel further

No.31593 of 2026(2) dt.12-05-2026 2/2 submits that from perusal of the order of the learned trial court, it transpires that the learned trial court has recorded that the informant sustained one head injury measuring 3" × 1 cm and one Rahul has also sustained head injury measuring 2" × 1 cm. It is submitted that both the injuries are superficial in nature. It is further submitted that the FIR does not specifically disclose as to which of the accused persons assaulted the injured. He further submits that a statement has been made in para 3 of the petition that petitioners have no criminal antecedent and they are languishing in judicial custody since 24.02.2026.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Dariyapur P.S. Case No. 159 of 2026.
