JUSTICE SATYAVRAT VERMA ORAL ORDER 08-02-2022 Heard the learned counsel for the petitioner and the learned APP for the State through Video Conferencing. The petitioner seeks bail in connection with Bakhtiyarpur P.S. Case No. 75 of 2021, instituted for the offences under Section 392 of the Indian Penal Code and Section 27 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 05.04.2021, he is a person with clean antecedent, charge-sheet has been submitted and allegation is of snatching Rs. 95,000/- from the informant by two unknown criminals who fired on the glass of the informant's car shattering the same, further the informant who is the cloth

The learned counsel for the petitioner submits that the FIR is against unknown and the name of this petitioner transpired in the confessional statement of co-accused, Aashu Kumar. Further nothing has been recovered from his possession nor the petitioner has been put on T.I. Parade. The learned A.P.P. vehemently opposes the bail application.

Considering the fact that the petitioner is in custody since 05.04.2021, he is a person with clean antecedent, chargesheet has been submitted and named transpired in the confessional statement of co-accused and nothing was recovered from his possession, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Bakhtiyarpur P.S. Case No. 75 of 2021, with condition that one of the bailor shall be the father of the petitioner (Birendra Kumar Singh @ Birendra
