JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-12-2020 Heard the learned counsel appearing for the petitioner and Shri Ashok Kumar, learned A.P.P. for the State. The present petition has been filed for modification of the order dated 02.07.2020 passed in Criminal Misc. No. 14547 of 2020 to the extent that the name of the concerned court, as mentioned in the 3rd last line at page no. 3 of the order dated 02.07.2020 as "Darbhanga" be replaced by "Madhubani", which had been wrongly typed in the prayer portion of the main petition itself, as also the time period granted to the petitioner for surrendering before the learned court below for the purposes of obtaining the privilege of anticipatory bail, be extended by a further period of six weeks from today.

No.27184 of 2020(2) dt.04-12-2020 2/2 The learned counsel for the petitioner has submitted that on account of the pandemic situation due to COVID-19, the petitioner could not surrender before the learned court below within the stipulated time frame, hence the time granted to surrender, may be extended.

Having regard to the facts and circumstances of the case, considering the submissions of the learned counsel for the petitioner and taking into account the averments made in the present petition, I deem it fit and proper to extend the time period granted to the petitioner to surrender before the learned court of A.C.J.M., Benipatti, Madhubani in connection with C.R. No. 87 of 2019, corresponding to Tr. No. 2472 of 2019, for the purposes of availing the privilege of anticipatory bail, by a further period of six weeks from today. It is further directed that the name of the concerned court in the 3rd last line at page no. 3 of the order dated 02.07.2020 be read as A.C.J.M., Benipatti, Madhubani. Accordingly, the order dated 02.07.2020 passed in Criminal Misc. No. 14547 of 2020 stands modified.

The petition stands allowed.
