JUSTICE MOHIT KUMAR SHAH ORAL ORDER 31-10-2025 It is submitted by the learned counsel for the opposite parties that pursuant to the order of this Court dated 26.6.2023 in CWJC No. 17358 of 2022, the Circle Officer, Bihariganj had initiated encroachment proceedings, vide Encroachment Case No. 1 of 2024-25 and notices were issued to the encroacher and after complying with the due process of law, the encroacher was directed to remove the encroachment in question, vide notice dated 19.7.2024. However, it is submitted that the said action of the Circle Officer, Bihariganj has been challenged by the

Patna High Court MJC No.1491 of 2024(3) dt.31-10-2025 2/2 encroacher, namely Ram Dev Darve, by filing a writ petition bearing CWJC No. 11840 of 2024, wherein this Court, vide order dated 19.8.2024 has directed for maintaining status quo qua the land / house of the said encroacher and it is submitted that the said writ petition is still pending as on date. 2.

At this juncture, the learned counsel for the petitioner seeks to intervene in the said writ petition bearing CWJC No. 11840 of 2024 and submits that the present petition be disposed off without causing any prejudice to the case of the petitioner. 3.

Accordingly, the present contempt petition stands disposed off.
