JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 25-11-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. Since the physical court proceeding is nonfunctional, due to present pandemic, COVID-19, the matter is listed with defects.

Learned counsel for the petitioner undertakes to remove the defects within three weeks of resumption of physical court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioner seeks bail in a case registered for the offence punishable under Section 304 B of the Indian Penal Code.

Petitioner in association of other family members is

Patna High Court CR. MISC. No.30228 of 2020(2) dt.25-11-2020 2/3 said to have killed the daughter of the informant by hanging her from a fan on non-fulfillment of demand of dowry. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case merely on suspicion as he happens to be the father-in-law of the deceased. There is nothing in the record indicating the complicity of the petitioner in the occurrence. It is further submitted that the deceased was living separately since six years with her husband. The husband of the deceased is already behind the bar. Similarly situated coaccused, namely, Rajo Devi and Pratima Kumari @ Pratima Devi have been enlarged on bail by different co-ordinate Bench of this court vide order dated 18.06.2020 and 24.01.2020 passed in Cr. Misc. Nos.84401 of 2019 and 713 of 2020 respectively. The petitioner has no criminal antecedent and has been languishing in custody since 27.11.2019.

Learned APP for the State opposed the bail petition.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned
