This application for anticipatory bail arises out of Bajpatti P.S. Case No. 373 of 2018 of 2018, disclosing offences under Sections 341, 323, 307, 354, 504 and 506 of the Indian Penal Code.
The petitioner is the mother-in-law of the informant. It is alleged that the informant's father-in-law and mother-in-law after having obtained bail in dowry demand case, assaulted her and had attempted to kill her by tightening a towel around her neck.
Learned counsel for the petitioner has submitted that there is no injury, which would justify the allegation against the petitioner. He has also submitted that it is because of the
Patna High Court CR. MISC. No.30610 of 2019(2) dt.09-05-2019 2/2 dispute between the husband and the wife that the present FIR has been lodged.
Considering the facts and circumstances, this application is allowed. Let the petitioner, above named, in the event of her arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned S.D.J.M.,Pupari, Sitamarhi in connection with Bajpatti P.S. Case No. 373 of 2018, subject to the condition as laid down under Section 438
(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present herself before the Police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
