The plaintiff has sought for some amendments in the Suit which is at initial stage.

Learned counsel for the respondents has submitted that the amendment which have been sought for will change the nature of the Suit.

I have gone through the amendment, in my view, the nature of the Suit will not be changed in view of the law laid down by the Hon'ble Supreme Court in the case of Life Insurance Corporation of India vs. Sanjeev Builders Private Limited 2022 SC 4277.

The Sub-Judge who is hearing the case is directed to dispose of the Title Suit within a year of communication of this

Patna High Court CWJC No.6287 of 2016(13) dt.05-09-2023 2/2 order and he will proceed ex parte against the non-cooperating party.
