Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

This application for regular bail arises out of Excise Case No. 164/2021, disclosing offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

Petitioners are in custody since 24.05.2021. Allegedly, from the vehicle in possession of these petitioners 339 litres of country-made liquor was recovered by the police. It has been

Mr. Ansul, learned counsel appearing on behalf of the petitioners has submitted that as the charge-sheet has been submitted, no tangible purpose would be served by keeping the petitioners in custody any more.

Considering the fact that the petitioners are in custody since 24.05.2021, this application is allowed. Let the petitioners, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount, each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Gaya in Excise Case No. 164 of 2021.
