Petitioner seeks bail in a case registered for the offences punishable under Sections 120(B), 409, 467, 468, 471A of the Indian Penal Code and Section 13(2)r/w 13(1)(c) and (D) of the Prevention of Corruption Act, 1988. The petitioner is Karamchari of the referred Block from where forged land possession certificate was issued and on the basis of those certificates, forged loan was sanctioned by the Bank. Consequently, FIR has been lodged against the Bank Authorities also.
Submission of the learned counsel for the petitioner is that the petitioner is in custody since
Patna High Court Cr.Misc. No.60026 of 2017 (10) dt.25-04-2018 18.05.2017. Only role of the petitioner is to recommend for grant of L.P.C.on the basis of physical verification and L.P.Cs are granted by the Circle Officer. Even, the petitioner had never recommended any of the forged L.P.Cs and the petitioner disputes his signature on those recommendations said to be given by the petitioner. The admitted signature and the disputed signature of the petitioner was verified by the expert. However, the report produced alongwith the supplementary affidavit would reveal that the opinion has not been expressed for want of better material for comparison of the signature.
Learned counsel for the C.B.I. opposed the prayer for bail on the ground that the petitioner has confessed before the police that in fact he had recommended for issuance of the L.P.C. He further admitted that L.P.C. of Ahsanul Ansari was signed by the petitioner also though Ahsanul Ansari had no land and petitioner expressed his ignorance as to how that happened.
Considering the nature of allegation against the petitioner and period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection
