====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-10-2020 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner is in custody in connection with Sour Bazar P.S.Case No.497 of 2016 for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 302 and 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner had earlier moved before this Court for grant of regular bail and the same was dismissed with a direction to the court below to expedite the trial and conclude the same within a period of nine months but the same has not been concluded as yet.

He further submits that petitioner has no criminal antecedent and he in custody since 29.03.2017.

No.26179 of 2020(2) dt.13-10-2020 2/2 Under the aforesaid circumstances, this application is disposed of with a direction to the court below to expedite the trial and conclude the same within a period of six months from today, failing which, the court below shall release the petitioner on bail, on appropriate terms and conditions as the court below may deem fit and proper. The trial court is required to submit report as to failure to conclude the trial as directed by this Court vide order dated 04.09.2017.

Let a copy of this order be communicated to the Registrar (Vigilance) of this Court for appropriate action against the court concerned.
