2. In the present case, the petitioner seeks bail in connection with Harsidhi P.S. Case No. 378 of 2024 registered on 11.07.2024 for the offences under Sections 310(2) of the BNS.

3. As per prosecution case, five persons entered into the branch of the informant in Spandana Spruti Finance Limited. After entering the branch, the miscreants started assaulting the staff members. After taking keys of locker, the miscreants decamped with Rs. 7,98,000/-. They also took away their mobile phones. The name of the petitioner transpired during investigation for also being involved in the occurrence.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.32276 of 2025(3) dt.01-09-2025 2/3 petitioner submits that the petitioner is innocent and has been falsely implicated in this case. No occurrence as alleged has ever taken place. The FIR was lodged against the unknown and the name of the petitioner transpired in this case on the basis of confessional statement of co-accused Anish Raj but there was money dispute between the petitioner and the co-accused and for this reason he has falsely implicated the petitioner in the present case. Nothing incriminating has been recovered from the person or possession of this petitioner and no Test Identification Parade has been conducted. After the petitioner was apprehended in this case, he has been made accused in three more cases and these cases are shown as the criminal antecedent of the petitioner. Petitioner is in custody since 28.10.2024 and charge-sheet has been submitted.

5. Learned A.P.P. opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner as well as submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like

No.32276 of 2025(3) dt.01-09-2025 3/3 amount each to the satisfaction of learned Judicial Magistrate1st Class, East Champaran/concerned court in connection with Harsidhi P.S. Case No. 378 of 2024, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
