2. Petitioner seeks regular bail in connection with Majhaulia P.S. FIR No. 520 of 2020 in a case registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.

3. As per prosecution story, the informant namely, Veer Sahni alleged that on 20.07.2020, the informant received information that his brother was shot dead at home. On enquiry, he came to know that Dinesh Sahni along with four to five others came to his house and shot him.

4. Learned counsel for the petitioner submits that initially FIR was registered against seven named and four to five unnamed accused persons. Name of the petitioner surfaced in this case on the basis of confessional statement of co-accused Vijay Yadav. He further submits that co-accused Vijay Yadav

Patna High Court CR. MISC. No.29583 of 2025(2) dt.04-07-2025 2/2 who confessed the name of the petitioner has already been granted bail by a co-ordinate Bench of this Court vide order dated 21.12.2022 passed in Cr. Misc. No. 72302 of 2022. Petitioner is in custody since 24.12.2024.

5. Learned A.P.P. for the State vehemently opposes the bail application and submits that petitioner has got three criminal antecedents, however he is on bail in all the cases as mentioned in paragraph no. 3 of the bail petition.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Majhaulia P.S. FIR No. 520 of 2020.
