Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner apprehends his arrest in Singhiya P.S. Case No. 86 of 2020, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

145.155 litres of foreign liquor has been recovered from the straw house situated in the cow shed of the petitioner. It is submitted that petitioner has falsely been implicated in this case. Nothing has been recovered from

Patna High Court CR. MISC. No.29827 of 2020(2) dt.16-12-2020 2/2 conscious possession of this petitioner. Recovery has been made from open place which is accessible to general public. Petitioner has got clean antecedent, as stated in para 3 of the petition. Counsel for the State vehemently opposed the bail application and submitted that recovery has been made from the straw house situated in the cow shed of the petitioner. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
