Patna High Court MJC No.1819 of 2017(5) dt.24-07-2023 2/3 ORAL ORDER (Per: HONOURABLE MR. JUSTICE P. B. BAJANTHRI) 24-07-2023 The present MJC contempt petition is filed for noncompliance of the order dated 03.10.2016, passed in CWJC No. 16665 of 2016.

2. The aforementioned writ petition was decided in the light of the order dated 24.11.2015, passed in CWJC No. 4309 of 2015 in the case of Sanjay Jha Vs. the State of Bihar & Ors. Perusal of the order passed in Sanjay Jha case, there is no direction to any authorities to do particular things or to undertake exercise. On the other hand, in para 28, liberty has been given to invoke Chapter (X) (B) of the Code of Criminal Procedure, 1973.

3. At this stage, learned counsel for the petitioner submitted that para 25 be taken note of for the purpose of entertaining the present MJC contempt petition.

4. Perusal of para 25, there is no positive direction.

5. That apart, learned counsel for the State submitted that certain action has been taken, to that effect show cause notice has been filed during the course of the day along with certain documents.

6. In the light of these facts and circumstances,
