JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 10-11-2020 Heard the parties through the virtual court proceeding. The petitioner seeks bail in connection with Bithan P.S. Case No. 105 of 2018 registered for the offences punishable under Sections 147, 148, 149, 302, 379, 504, 506 of the Indian Penal Code.
According to the F.I.R., while the son of informant was sitting at his door, in the meantime, this accused petitioner along with other F.I.R. name accused persons came where quarreling was made in front of the house of informant in the meantime co-accused Rajesh, Rakesh, Sanjeev and Nand Kishor, who were carrying cloth from pick up van seeing road was blocked, then the accused persons gave order to kill at this co-accused Gulab Bakho assaulted with Danda which hit on the stomach of son of informant and co-accused Muniya Khatoon
Patna High Court CR. MISC. No.25619 of 2020(3) dt.10-11-2020 2/2 assaulted with iron rod, which hit on his hydrocele and in course of treatment, son of informant died.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. There is specific allegation against the co-accused Gulab Bakho and Muniya Khatoon. He further submits that the petitioner is in jail custody since 17.02.2020 and the petitioner has got no any criminal antecedent.
Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Rosera, District- Samastipur in connection with Bithan P.S. Case No. 105 of 2018.
