The petitioner has preferred this application for grant of regular bail in connection with Kanhauli P.S. Case No. 194 of 2022 dated 15.12.2022 registered for the offences punishable u/s 30(a) of the Bihar Prohibition and Excise Act. As per the prosecution case, total 648 litres of Nepali Saufi liquor was recovered from the possession of the petitioner. The petitioner was also apprehended with Sumo Victa vehicle. Patna High Court CR. MISC. No.32021 of 2023(2) dt.22-05-2023 2/2 purchase liquor from Shambhu Rai and do liquor business. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is neither the owner nor the driver of the said vehicle. The petitioner is accused in four cases as stated in para 3 of the bail petition. The petitioner is in custody since 15.12.2022.
Learned A.P.P. for the State has vehemently opposed the prayer of bail petition of the petitioner. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sitamarhi in connection with Kanhauli P.S. Case No. 194 of 2022.
The application stands allowed.
