JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-12-2024 Though the present writ petition has been filed for directing the Respondent-Bihar State Housing Board, Patna, to refund the amount deposited by the petitioner for allotment of house / plot under the H.I.G. category with interest, however, at the outset, the learned counsel for the Respondent-Bihar State Housing Board, Patna, has submitted, by referring to the supplementary counter affidavit filed in the present case that a sum of Rs. 4,79,804/- has already stood paid to the petitioner by way of refund of the amount deposited by the petitioner for allotment of plot at Digha, Patna, inasmuch as the same has been deposited in the account of the petitioner through

Patna High Court CWJC No.1175 of 2017(6) dt.05-12-2024 2/2 NEFT/RTGS, hence, it is submitted that the present writ petition has been rendered infructuous.

This Court finds that the aforesaid stand taken by the Respondent-Bihar State Housing Board, Patna, has not been controverted by the petitioner, inasmuch as no rejoinder affidavit has been filed, hence, apparently, the grievance of the petitioner has stood redressed, thus, the present writ petition stands disposed off.
