JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-08-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Daudnagar P. S. Case No. 311 of 2017, registered for offences punishable under Sections 311 of 2017 of the Indian Penal Code.

As per F.I.R., allegation against the petitioner along with three miscreants snatched away key of the motorcycle of the informant and opened the dickey of motorcycle and took away the jewelries, cash of Rs. 50,000/- and mobile and thereafter they decamped on their own bike.

Submission of the learned counsel for the petitioner is that the petitioner is not named in the F.I.R. later on, the name of the petitioner transpired on the confession of co-accused, Hemant

Patna High Court Cr.Misc. No.50672 of 2018 (2) dt.31-08-2018 2/2 Kumar and there is no direct evidence against the petitioner to prove the allegation.

Learned A.P.P. opposes the prayer for bail.

n In view of allegation against the petitioner, above named, that he is accused in five other cases , above named, I am not inclined to grant bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected with a direction to the petitioner that if the petitioner surrenders before the Court below and makes prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of this Court.

With the aforesaid observation, this application is dismissed.
