Mr. Subhash Pd. Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-10-2018 The grievance of the petitioner in the instant case is non-consideration of the case of the petitioner for grant of graduate trained scale.

Learned counsel appearing on behalf of the petitioner submits that juniors to the petitioner have been granted such scale but without any rhyme and reason, petitioner has been discriminated.

Considering the aforesaid fact, the writ petition is disposed of with direction to the respondents to examine the claim of the petitioner and if it is found that the juniors to the petitioner have been granted such promotion, the case of the

Patna High Court CWJC No.22197 of 2012(4) dt.11-10-2018 2/2 petitioner may be considered strictly in terms of the 1993 promotion rule by which provision has been made for grant of promotion on completion of Kalawadhi.

Necessary decision on the claim of the petitioner may be taken by the respondents at the earliest preferably within a period of four months from the date of receipt/production of a copy of this order.

With the aforesaid, the writ petition stands disposed of.
