JUSTICE BIRENDRA KUMAR ORAL ORDER 09-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420,406,464,323,379/34 of the Indian Penal Code. Wife of the petitioner had lodged KMP P.S.Case No.254 of 2018 against the husband of the informant of this case relating to an offence of cheating of Rs.5,50,000/-. Thereafter, the parties entered into an agreement and the husband of the informant issued a refund cheque which bounced.

Submission is that just to pressurize, the present false case has been lodged with allegation that the petitioner cheated to the informant by receiving money for

Patna High Court Cr.Misc. No.51557 of 2018 (2) dt.09-10-2018 2/2 providing loan from the referred Govt. Scheme. Considering the background of allegation as well as nature of the allegation, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Kazi Mohammadpur (KMP) P.S. Case No.253 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
