Petitioners apprehend arrest in a case registered for the offence punishable under Sections 307, 498, 504, 506/34 of Indian Penal Code and Sections 3/4 of Dowry Prohibition Act. As per prosecution case, all the co-accused persons including the petitioners subjected the daughter of the informant to cruelty for dowry demand and assaulted the informant along with his son causing injury on the head of the informant. Learned counsel appearing for the petitioners submit that the petitioners are innocent and have falsely been implicated in this case. Petitioner no. 1 is cousin, petitioner no.

Patna High Court CR. MISC. No.29909 of 2022(2) dt.29-09-2022 2/2 2 father-in-law and petitioner no. 3 is cousin brother-in-law. It is submitted that specific accusation is against the husband and father-in-law of the informant who are already in custody. Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate V, Kaimur at Bhabhua in Bhagwanpur P. S. Case No. 42 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
