The instant writ application has been filed for issuance of a direction to the respondent authorities to transfer the petitioner from Bikram Nagar Panchayat, Patna to any school in Patna Sadar as opted by the petitioner i.e. Shri Ramdhan Singh Yadav Sarvoday Madhya Vidyalaya, Punaichak, Patna and near by school in Patna Sadar.

3. Learned counsel for the petitioner submits that the petitioner was appointed as on 15.11.2023 on the post of Teacher and has been discharging his duties to the satisfaction of the authorities.

It is submitted that the Education Department, Government of Bihar, issued a transfer policy for teachers vide Memo No.1729 dated 07.10.2024, wherein teachers have been permitted to seek transfer on the basis of special circumstances. The petitioner submitted an application seeking his transfer under Clause (iii) from Muzaffarpur to Patna district, categorically stating therein that his son is disabled and suffering from autism, requiring him to take special care of his son and regularly visit the rehabilitation centre for his treatment. It is further submitted that the Department considered his application and was transferred to Primary School, Karasa, Bikram Nagar Panchayat, Bikram, Patna which is at a distance of 55 Kilometer from the residence of the petitioner.

It is further submitted that in the light of the departmental letter no. 37 dated 28.04.2025, the petitioner submitted an application for transfer through E-Siksha Koash on 16.03.2026, which is still pending adjudication. It is next submitted that since a policy already exists to address such grievances, the petitioner's case ought to be considered in accordance with the said policy.

5. On the other hand, learned counsel for the State has no objection with regard to the submissions made by the petitioner.

Considering the aforesaid facts and circumstances, the respondent nos. 3 & 4 are directed to consider the request for transfer made by the petitioner and to post him against any available vacancy from the options given by him on the eShikshakosh portal. It is expected that the respondent authorities shall pass an appropriate order posting the petitioner at a place where a vacancy exists among the options exercised by him, within a period of six weeks from the date of receipt/production of a copy of this order.

7. With the aforesaid observations and directions, the writ application stands disposed of.
