JUSTICE SANJAY PRIYA ORAL ORDER 06-05-2019 Heard the learned counsel for the petitioners, the informant and the learned A.P.P. for the State. The petitioners seek Bakhraj P.S. Case No. 102/2018, bail in, instituted for offences under Section(s) 364, 302, 120(B) and 34 of the Indian Penal Code.
It is alleged in the written report that son of informant had gone with Prakash Paswan and Karan Paswan to see T.V. but he did not return. During course of search at about 4:00 A.M., informant found these petitioners along with other accused persons were taking the body of her son.
Patna High Court CR. MISC. No.29072 of 2019(2) dt.06-05-2019 2/2 Learned counsel for the petitioner has submitted that informant is not eye-witness to the occurrence. Mere suspicion has been raised against these petitioners.
Learned counsel for informant has opposed the prayer for bail of petitioners.
Petitioners are in custody since 25.02.2019 having clean antecedent.
Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Muzaffarpur, in connection with Bakhraj P.S. Case No. 102/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners. (Sanjay Priya, J) rakhi/- U T
