The petitioner who is in custody since 08.11.2018 has filed the instant application for grant of bail in connection with Kishanganj P.S. Case as No. 687 of 2018 registered for the offence punishable under sections 363 and 366(A) of the Indian Penal Code.
As per the allegation in the FIR, the informant went to get her minor daughter from school where she found her daughter missing. It is further alleged that she had seen her daughter rebuking Md. Nadim on phone and as such she was apprehensive that it was Md. Nadim who along with others have kidnapped her daughter. Subsequently, the daughter of the

No.29955 of 2019(4) dt.21-08-2019 2/3 informant was recovered and her statement was recorded under section 164 Cr.P.C wherein she has named three persons including the petitioner and one Niyaz who are said to have taken her from the school. It is stated that the petitioner and Niyaz had taken her to Purnea and had handed over to Nadim. Nadim kept her in Sitamarhi for 8-9 days and was asking her to enter into Nikah or else to give him Rs. 5 lacs. It is submitted by learned counsel for the petitioner that the allegations against the petitioner are false and concocted. The co-accused Md. Niyaz Ahmad has been enlarged on bail by order dated 08.02.2019 passed in Cr. Misc. No. 14552 of 2019 and the case of the petitioner stands on similar footing to that of co-accused Md. Niyaz.
The application for bail has been opposed by the learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the fact that the co-accused Md. Niyaz Ahmad has been enlarged on bail, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial
