27-06-2018 Heard Sri Ugranath Mallik, learned counsel for the petitioner and learned A.C. to Addl. Advocate General - 3. None appeared on behalf of Govt. of India.

The present petition has been filed with a prayer to restore C.W.J.C. No. 4846 of 2014, which stood dismissed due to non-compliance of peremptory order dated 11-02-2016. Learned counsel for the petitioner, by way of referring to fact disclosed in paragraph - 3 of the petition, submits that due to inadvertence, the petitioner filed petition, in compliance with earlier order, belatedly. It has been argued that learned counsel for the petitioner thought that six weeks' time was granted, whereas, actually four weeks time was granted, however; within six weeks, he has already complied the order dated 11-02-2016 passed in C.W.J.C. No. 4846 of 2014.

Patna High Court MJC No.1757 of 2017(4) dt.27-06-2018 2/2 In view of facts and circumstances, the restoration petition is allowed.

Let C.W.J.C. No. 4846 of 2014 be restored to its original file.
