Petitioner is apprehending his arrest in connection with Complaint Case No.974 of 2018 , registered for offences punishable under Section 498(A) of the Indian Penal Code and Section 4 of the D.P.Act.

Matter relates to Section 498(A) of the IPC with allegation of demand and torture. Petitioner happens to be husband of the complainant. It further appears that on appearance of the complainant, the matter was referred to the Mediation Centre but the meditation failed.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.28399 of 2019(4) dt.17-10-2019 2/2 that he is still ready to keep her with dignity and care but before the mediator she was not ready to reside and on the request of the O.P.no.2 he has handed over the house-hold articles to her but she is still not ready to settle the dispute. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the learned court below within a period of three weeks from the date of receipt of the order and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Begusarai in connection with Complaint Case No.974 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
