====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 21-11-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 379, 354(B) and 34 of the Indian Penal Code. The informant alleges that on 05.09.2021 at about

No.30515 of 2022(2) dt.21-11-2022 2/3 5:00 pm, the petitioners along with other accused persons entered his house, further petitioner no. 6 assaulted the mother of the informant with an iron rod causing him fracture, it is next alleged that petitioner Alisha Praween assaulted her with fists, thereafter, Mehtab attempted to disrobe his sister-in-law and Tannu and Banti broke open the box and took away Rs. 20,000/- and assaulted the informant with an iron rod on her shoulder, it is further alleged that the reason for the occurrence was that wife of the informant was talking on mobile phone with another boy and on protest of the same the occurrence took place.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and have been falsely implicated in the present case, it is next submitted that date of occurrence is 05.09.2021 and the FIR came to be instituted on 08.09.2021, the parties are close relatives and a joint compromise petition has been filed on 12.10.2021. Learned counsel next submits that the delay in instituting the FIR has not been explained.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court
