2. The accused/petitioner is named in the FIR and apprehending his arrest in connection with Daudpur P.S. Case No.362 of 2023 registered under Sections 147, 341, 323, 354-B, 504 and 506 of the Indian Penal Code.

3. The allegation against the petitioner is to confine unlawfully the daughter of informant in a room belongs to one Rajnath Sigh with bad intention and also to outrage modesty of wife of the informant during course of occurrence.

4. Learned counsel appearing on behalf of the petitioner submitted that statement of victim/daughter of the

No.33392 of 2025(2) dt.22-05-2025 2/3 informant was recorded under Section 164 of the Cr.P.C., where she raised specific allegation only against co-accused Ayran @ Aditya Kumar as to close her in a room of one Raj Nath Singh with bad intention. Petitioner was not named in her statement recorded under Section 164 of the Cr.P.C. It is pointed out that petitioner found involved in one more criminal case of different nature, where he is on bail.

5. Learned APP opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances and by taking note of statement of the victim as recorded under Section 164 of Cr.P.C., where no incriminating statement prima facie available against this petitioner, accordingly, the petitioner, above-named, in the event of his arrest or surrender in the court below within a period of four weeks from today, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, First Class, Saran at Chapra/concerned court, where case is pending in

Patna High Court CR. MISC. No.33392 of 2025(2) dt.22-05-2025 3/3 connection with Daudpur P.S. Case No.362 of 2023, subject to the conditions as laid down under Section 438(2) of the CrPC/under Section 482(2) of the BNSS.
