02. In the present case, the petitioner seeks bail in connection with Telhara P.S. Case No. 37 of 2025 registered for the alleged offences under Sections 137(2), 140(3) of Bharatiya Nyaya Sanhita, 2023.
03. As per prosecution case, minor son of the informant was kidnapped and ransom demand of Rs. 5,00,000/- was made. The name of the petitioner transpired during investigation for being involved in the said occurrence.
04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The name of the petitioner transpired in the confessional statements of co-accused persons-Pankaj Kumar and Deepak
Patna High Court CR. MISC. No.30699 of 2025(3) dt.01-09-2025 2/3 Kumar and except for the confessional statements of coaccused, there is no material against the petitioner. Learned counsel further submits that the kidnapped body was recovered and three persons have been apprehended from the said place. The statement of the victim boy was recorded but he has not named the petitioner, though other co-accused persons have been named by him. Learned counsel further submits that similarly placed co-accused persons, namely Deepak Kumar and Abhimanyu Kumar, have been granted bail by the different Coordinate Benches of this Court vide order dated 05.05.2025 passed in Criminal Misc. No. 26560 of 2025 and order dated 06.08.2025 passed in Criminal Misc. No. 27709 of 2025, respectively. The petitioner is in custody since 24.02.2025 and charge-sheet has been submitted. The petitioner is having clean antecedent.
05. Learned APP for the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the vague nature of allegation against the petitioner and also considering the absence of cogent material against the petitioner and further considering the period of custody of the petitioner
Patna High Court CR. MISC. No.30699 of 2025(3) dt.01-09-2025 3/3 along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Hilsa (Nalanda)/court concerned in connection with Telhara P.S. Case No. 37 of 2025, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
