1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Manjhagarh P.S. Case No.247/2023, registered for the offences punishable under Sections 302, 34 of the Indian Penal Code.

3. By an order dated 09.05.2025, a report was called from the learned Additional District and Sessions Judge-XII, Gopalganj with regard to the stage of the trial in connection with Manjhagarh P.S. Case No.247/2023, Trial No.38/2024. The learned District and Additional Sessions Judge-XII, Gopalganj had sent the report contained in letter no. 157 dated 16.05.2025 and from perusal of the same, it manifests that both prosecution witnesses including the informant have been examined and now

Patna High Court CR. MISC. No.31049 of 2025(3) dt.20-06-2025 2/2 only doctor and I.O. are left for examination.

4. Since all the non-official witnesses have been examined and only official witnesses are remained to be examined, as such, the Court is not inclined to release the petitioner on bail.

5. The regular bail application of the petitioner is rejected.

6. However, directs the District Magistrate, Gopalganj and the Superintendent of Police, Gopalganj to ensure that doctor and the I.O. remain physically present in the trial on the next date fixed.

7. Let a copy of this order be sent to the District Magistrate, Gopalganj and the Superintendent of Police, Gopalganj for their perusal.
