The present writ petition has been filed for setting aside the order dated 28.03.2012 passed by the respondent no.5 by which the candidature of the petitioner has been rejected on the ground that the petitioner has submitted a caste certificate of Extremely Backward Class, in fact the petitioner belongs to the

Patna High Court CWJC No.16868 of 2012 dt.16-02-2024 2/2 Backward Class.

Learned counsel for the Board has filed a detailed counter affidavit stating therein that the petitioner has passed all the examinations including the physical test and the written examinations but at the time of the document verification it was found that the petitioner belongs to the Extremely Backward Class but in his application he has mentioned that he belongs to the Backward Class. On the basis of the mismatch of the caste certificate submitted by the petitioner, the candidature of the petitioner has been rejected by the competent authority.

4. Learned counsel for the State submits that this issue is settled by this Hon'ble Court vide order dated 06.09.2011 passed in C.W.J.C. 9901 of 2011 (Bikash Kumar Vs. The State of Bihar and others) and vide order dated 12.01.2012 passed in C.W.J.C. 19808 of 2011 (Raj Kumar and others Versus The State of Bihar and others).

5. In view of the aforesaid there is no merit in the writ application. Accordingly, this writ application stands dismissed.
