The petitioner is apprehending his arrest in connection with Naugachia Mahila P.S. Case No.21 of 2018 G.R. No.1931 of 2018, registered for offences punishable under Sections 354(B), 504, 506/34 of the Indian Penal Code and 12 POCSO Act and 66A of I.T. Act. Allegation against the petitioner is that one co-accused has taken obscene photograph of the daughter of the informant and threatened her if he makes complain about the same, she would be killed and assaulted.

Submission of the learned counsel for the petitioner is that allegation of taking obscene photograph is against brother of the petitioner, not against the petitioner. There is general and omnibus

Patna High Court Cr.Misc. No.51163 of 2018 (2) dt.07-09-2018 2/2 allegation made against the petitioner.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-Ist, Bhagalpur, in connection with Naugachia Mahila P.S. Case No.21 of 2018 G.R. No.1931 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
