2. The accused/petitioner apprehending his arrest in connection with Muffasil P.S. Case No. 786 of 2025 registered for the offences punishable under Sections 316(2), 318(4) of Bhartiya Nayay Sanhita 2023.

3. As per FIR, petitioner alleged to cheat informant for a sum of Rs. 4.5 lakhs against a land deal, which was not actuated in terms of sale deed.

4. It is submitted by learned counsel appearing on behalf of the petitioner that the dispute is primarily civil in nature. It is submitted that the petitioner received only Rs. 2

Patna High Court CR. MISC. No.30890 of 2026(2) dt.12-05-2026 2/3 lakh, which he is ready to pay at any point of time. Petitioner claimed clean antecedent.

5. Learned APP opposed the prayer of bail.

6. Learned APP, duly assisted by learned counsel Mr. Krishna Deo Raj, appearing on behalf of the informant, while opposing the prayer of bail submitted that the total payment of Rs. 4.5 lakhs was made to petitioner in connection with the land deal.

In view of aforesaid factual submissions and by taking note of fact as disputes primarily appears civil in nature, coupled with the fact that petitioner is ready to return Rs. 2 lakhs at any point of time, accordingly, above named petitioner, in the event of his arrest or surrender before the learned trial Court, within a period of four weeks of the order, is directed to be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya Ji/concerned Court, where the case is pending in connection with Muffasil P.S. Case No. 786 of 2025 subject to the conditions as laid down under Section

No.30890 of 2026(2) dt.12-05-2026 3/3 482(2) of the BNSS, with further condition that:- Petitioner is directed to furnish demand draft of Rs. 2 lakh in the name of informant at the time of furnishing of bail bond, failing which the bail bond of the petitioner shall not be accepted by the learned trial court.
