The present writ application has been filed seeking direction upon the respondents to ensure payment of an amount of deduction under the Central Government Employees Group
Patna High Court CWJC No.12873 of 2021 dt.22-11-2022 2/3 Insurance Scheme (CGEGIS) for the period 15.06.1982 to 24.07.1987, to the tune of Rs.56,598 along with statutory interest for the service period rendered by the petitioner in central government .
It is submitted that the petitioner was appointed on the post of Supervisor (Civil) under the Government of India, in the Ministry of Irrigation, Sone River Commission, way back in 1982 vide Annexure 1 to the writ application. He remained in service of Government of India till 31.07.1987, however, consequent upon his selection through B.P.S.C. in State of Bihar, he relinquished the charge of the office of Extra Assistant Director, with effect from 24.07.1987 after tendering his resignation. He further submits that though the petitioner relinquished his post with effect from 24.07.1987 but till date the amount of deduction under CGEGIS for the period of 5.06.1982 to 24.07.1987 has not been paid to him. He further submits that for ventilating his grievance, he also filed representation before respondent nos. 5 to 6, but till date no order has been passed .
In view of the submissions made on behalf of the learned counsel for the petitioner, the present writ application stands disposed of with a direction to the petitioner to file a fresh representation before the respondent nos.5 and 6, within a period
Patna High Court CWJC No.12873 of 2021 dt.22-11-2022 3/3 of four weeks from today along with a copy of this order and the materials in support of his claim.
If such a representation is filed, the concerned respondent nos.5 and 6 shall dispose of the same by a reasoned and speaking order, preferably within a period of further eight weeks.
It is needless to say that if the claim of the petitioner finds favour, the necessary order for payment of the amount under CGEGIS shall be made along with admissible interest. Accordingly, the present writ application stands disposed of with the aforesaid direction.
