2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 336(3), 332, 340(2), 318(4), 319(2), 317(3), 317(4) & 3(5) of the BNS and under Sections 25(1-B)a, 26 & 35 of the Arms Act.

3. The case of the prosecution is that from the possession of this petitioner one mobile, one country made pistol and a live cartridge were recovered.

4. Learned counsel for the petitioner submits that this case is based on the self-statement of police officer. Nothing has been recovered from the possession of this petitioner, rather he has been framed in this case due to his criminal antecedents. The petitioner is in custody since 02.01.2025.

5. Learned APP appearing for the state has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kalyanpur P.S. Case No. 01 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-12, East Champaran. Motihari.
