The petitioner apprehends his arrest in connection with Birpur P.S. Case No. 68 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act pending in the Court of 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Begusarai.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to enmity of local party politics. Further submission is that petitioner has no criminal antecedent.
Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that
Patna High Court CR. MISC. No.30234 of 2020(2) dt.05-03-2021 2/2 petitioner is named in the first information report and the recovery has been made from the house of the petitioner. Hence, the petitioner does not deserve to be enlarged on bail. Having considered the facts and circumstances of the case and the submission advanced on behalf of the parties, this is not a fit case for bail. Accordingly, prayer of the petitioner for bail is rejected.
