JUSTICE JITENDRA KUMAR ORAL ORDER 08-08-2025 The present Criminal Revision petition has been preferred against the impugned order dated 21.01.2021 passed by learned 1st Additional District and Sessions Judge-cumSpecial Judge (SC/ST Act), Madhubani, C.R. Case No. 04 of 2020, whereby learned court below has dismissed the complaint filed by the Complainant, who is petitioner herein.

2. However, in view of Section 41A of the SC/ST Act, 1989, appeal lies against any judgment, sentence or order not being an interlocutory order and the impugned order is a final order terminating the Criminal Proceedings before learned court below. Hence, as per Section 41A of SC/ST Act, 1989, appeal

3. The Complainant who is petitioner herein, however, has filed the present Criminal Revision petition and at this stage, he is seeking permission to convert the present petition into Criminal Appeal.

4. Permission is granted.

5. Hence, office is directed to convert the present Criminal Revision petition into Criminal Appeal if the required steps are taken by the petitioner and list this matter before appropriate Bench after obtaining necessary permission from Hon'ble the Chief Justice.
