This is the second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier bail application of the petitioner was dismissed vide order dated 23.02.2022 passed in Cr. Misc. No. 33940/2021 with an observation that the petitioner may renew his prayer for bail after three months. As per prosecution case, some unknown persons committed theft in the house of the informant and took away household articles, jewelry and clothes etc. The name of the petitioner has transpired on the basis of confessional statement made by the co-accused.

Learned counsel for the petitioner submits that petitioner is not named in the FIR and he has been made accused on the basis of confessional statement of a co-accused, namely, Gulsan Kharwar @ Gulshan Kharwar who along with other accused persons have been granted bail by this Court vide Cr. Misc. No. 32207/2021 (Annexure-3). Petitioner is in custody

Patna High Court CR. MISC. No.30497 of 2022(2) dt.22-06-2022 2/2 since 19.08.2020, the charge-sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidences.

Regards being had to the submissions made by the parties and taking into consideration the fact that this is the second attempt for bail on behalf of the petitioner, he is in custody since 19.08.2020 and the co-accused persons have been granted bail by this Court, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, namely, RISHI KAPOOR @ RISHI KUMAR @ CHUNCHU @ CHUCHU be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal in connection with Karpi PS Case No. 13/2020 subject to the condition that the petitioner will be well represented on each and every date in the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled.
