JUSTICE SHIVAJI PANDEY ORAL ORDER 20-07-2018 Learned counsel for the petitioner submits that the petitioner may be given liberty to challenge the order contained in Memo No. 502 dated 19.5.2017 passed by the District Magistrate-cum-Collector, Vaishali before the Divisional Commissioner, Tirhut Division, Muzaffarpur.
Let the petitioner should exhaust the alternative remedy as is available in law and if such an appeal is filed by the petitioner within a period of three weeks from today, the Divisional Commissioner, Tirhut Division, will dispose of the same within a period of four months from the date of filing of the appeal by the petitioner.
The Divisional Commissioner, while considering the
Patna High Court CWJC No.13521 of 2017(3) dt.20-07-2018 2/2 issue of limitation, will take cognizance of the pendency of this writ application before this Court.
With the aforementioned observation and liberty, this writ application is disposed of.
