The petitioner apprehends his arrest in connection with Ara Nawada P.S. Case No.36 of 2023 registered under Section 307 of the Indian Penal Code and other allied sections of the I.P.C. and section 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No specific allegation is made against the petitioner rather specific allegation is made against co-accused Prince Kumar. It is further submitted that both parties have compromised the case vide Annexure 2 to this petition. The petitioner has got no criminal antecedent.
Having considered the facts and circumstances of the
Patna High Court CR. MISC. No.31958 of 2023(2) dt.21-07-2023 2/2 case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P.S. Case No.36 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
