1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a), 32(2), 41(1) of Bihar Prohibition and Excise (Amendment) Act, 2018.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and allegation is of recovery of 5718.6 litres of liquor from four vehicles as detailed in the F.I.R. It is next submitted that petitioner is assistant driver of one of the seized vehicles came to be implicated when he was not aware what was being transported in the vehicle and he is in custody since 29.12.2023.

4. Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.35304 of 2024(2) dt.17-05-2024 2/2 bail of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs.5000/- (Rupees five thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Patepur P.S. Case No.323/2023.
