2. The petitioner apprehends arrest in a case registered for offence under Sections 363 , 366A and 34 of the Indian Penal Code .
3 . As per prosecution case, all the F.I.R. named accused persons including this petitioner kidnapped the minor daughter of informant on motorcycle .
4. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case . The victim, in her statement recorded under Sections 161 Cr.P.C., as well as 164 has stated that she was in love with this petitioner for the last two years and wanted to marry with him and on 28.05.2023 she went to Delhi with this petitioner and solemnized marriage
Patna High Court CR. MISC. No.44153 of 2024(5) dt.26-10-2024 2/2 with him and both are living together as husband and wife and she is also two months pregnant. Petitioner claims clean antecedent.
5 . Learned A.P.P. for the State vehemently opposed the bail petition .
6. Considering the statement of the victim recorded under Section 164 Cr. P . C., in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge - VI Banka in connection with Banka P.S. case No. 359 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
