JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-08-2019 Petitioners seek bail in anticipation of their arrest in connection with Kadamkuan P.S. Case No. 317 of 2012 registered for the offences punishable under Sections 418, 506, 498A, 120B of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act. Allegation against the petitioners, who are mother-in-law and father-in-law, is that they demanded One crore rupees and for that daughter of the informant was subjected to cruelty and torture. Submission of learned counsel for the petitioners is that a divorce decree has already been passed in America in favour of son of the petitioners, which is Annexure-2 to the petition and a petition has been filed by the daughter of the informant against the decree of divorce and that petition has also been dismissed in America, which is Annexure-3 series and there is no specific allegation against them

Patna High Court CR. MISC. No.34947 of 2019(3) dt.22-08-2019 2/2 and they are residing in America and investigation is still going on. Heard learned APP also.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M.-VII, Patna, in connection with Kadamkuan P.S. Case No. 317 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that petitioners have to appear before the I.O. and co-operate in the investigation, one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned, petitioners shall leave the country only with the permission of the court concerned and further petitioners have to file an undertaking before the court that they will appear before the court as and when required if sufficient time is allowed to them.
