Mr.Anant Kumar 1, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 19-06-2024 Heard learned counsel for the petitioner as well as learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 302 and 34 of the IPC in connection with Hajipur Sadar P.S. Case No.756 of 2023.

3. The learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a women and has been falsely implicated in the instant case by the informant on account of dispute relating to land.

4. It is next submitted that informant alleges that on 06.10.2023 at about 04:00 PM an altercation took place in between informant's son (Prince Raj) and Tetar Devi and the son of the informant himself informed the informant from his mobile regarding the said altercation, accordingly the informant

Patna High Court CR. MISC. No.36084 of 2024(2) dt.19-06-2024 2/3 went to the place of occurrence where she found the dead body of her son lying on a cot in Verandah of Birju Sah, thus based on suspicion alleges that the petitioner along with other accused persons killed her son. The learned counsel submits that informant is not an eyewitness to the occurrence, the entire allegation hinges around suspicion and the petitioner is related and there is dispute relating to land. It is also submitted that Terar Devi with whom the son of the informant was having altercation is not made an accused who is wife of Birju Sah where the dead body was found lying on the cot. The learned counsel next submits that petitioner will not abscond rather will cooperate in the investigation.

5. The learned APP opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No.756 of

Patna High Court CR. MISC. No.36084 of 2024(2) dt.19-06-2024 3/3 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
