The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 379, 504, 506, 34 of the Indian Penal Code.

As per the prosecution case, these two petitioners alongwith other co-accused persons assaulted with butt of pistol, lathi and danda, due to which, informant sustained injury. It is further alleged that petitioner no. 1 snatched mobile phone from informant, whereas, petitioner no. 2 took away his gold locket and purse containing cash from his pocket.

It is submitted on behalf of petitioners that petitioners have been falsely implicated in this case due to land dispute.

Patna High Court CR. MISC. No.29986 of 2022(2) dt.29-09-2022 2/2 F.I.R. has been lodged after a delay of ten days without any plausible explanation of delay. The injury sustained by the informant is simple in nature. Petitioners have got clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Begusarai in connection with Matihani P.S. Case No. 25 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
