2. The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code.
3. As per FIR, a dead body of a woman was found under Mahadeva O.P. Further, on the basis of information, informant came and recognized the dead body as his Bhabhi (sister-in-law). It is further alleged that land dispute was going on between the informant and one co-accused.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the petitioner has been made accused in this case on the basis of confessional statement of co-accused. He submits that there is no eye witness to the occurrence. He
Patna High Court CR. MISC. No.33457 of 2024(2) dt.10-05-2024 2/2 submits that there is no specific overt act against the petitioner. He submits that similarly situated co-accused has already been granted bail by a Bench of this Court vide order dated 08.11.2023 passed in Cr. Misc. No. 72234 of 2023. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstances of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Siwan (M) Mahadewa O.P. P.S. Case No. 123 of 2023.
